CALIFORNIA CONSUMER PRIVACY ACT NOTICE FOR EMPLOYEES, JOB APPLICANTS, CONTRACTORS, OWNERS, DIRECTORS, AND OFFICERS
Boyd Gaming Corporation (“we,” “our,” or “us”) is providing this Jobs Privacy Policy which describes how we may collect and process Personal Information from California residents in the context of their current, former, or potential role as our employees, job applicants, contractors, owners, directors, or officers, including their emergency contacts, dependents, and beneficiaries. We supply this information consistent with the California Consumer Privacy Act of 2018, as significantly amended by the California Privacy Rights Act of 2020 (CPRA), (collectively, CCPA), and the CCPA Regulations, which provides for a privacy notice describing the categories of Personal Information collected and used regarding California residents in the roles listed above.
Under the CCPA, “Personal Information” is information that identifies, relates to, or could reasonably be linked with a particular California resident or household.
Categories of Personal Information
We may collect and retain the following categories of Personal Information:
Information You Provide Directly to Us:
- Personal Information, as defined in the California customer records law, such as name, contact information, online identifiers, IP address, Social Security numbers, and other government-issued ID or numbers, education information, employment history, financial information, work authorization, signature, and medical and medical insurance information;
- Characteristics of protected classifications under California or federal law, such as sex, age, race, religion, national origin, disability, medical conditions and information, citizenship, immigration status, request for leave, and marital status;
- Geolocation data, such as device location;
- Audio, electronic, visual, and similar information, such as photographs or audio or video recordings;
- Professional or employment-related information, such as work history, prior employer, information relating to references, details of qualifications, skills and experience, human resources data, and data necessary for benefits and related administration services;
- Education information subject to the federal Family Educational Rights and Privacy Act; and
- Inferences drawn from any of the Personal Information listed above to create a profile or summary about, for example, an individual’s preferences, behavior, or characteristics.
Information We Collect Automatically:
- Internet or network activity information, such as browsing history and interactions with our and other websites and systems.
Information We Collect from Other Sources:
- We also receive the categories of information described above from other sources, which includes government entities that make information publicly available, entities that sell data, and third-party service providers and partners, and other employees.
Some of the categories of information described above may be considered “sensitive” under applicable law. In the event we collect sensitive personal information, we collect, use, retain, or disclose it only for purposes permitted under applicable law. We will not sell the Personal Information, including any sensitive Personal Information, we collect about our employees or applicants for employment or share it with third parties for cross-context behavioral advertising.
Use of Personal Information
We may use this Personal Information for the purposes of operating, managing, and maintaining our business, managing our workforce, and accomplishing our business purposes and objectives, including, for example, using Personal Information to:
- Manage workforce activities and personnel generally, including for recruitment, performance management, career development, payments administration, employee training, contacting emergency contacts or your beneficiaries, leaves, and promotions.
- Manage wages and other awards such as stock options, stock grants and bonuses, provide healthcare, pensions, savings plans and other benefits.
- Maintain and secure our facilities, equipment, systems, accounts, and infrastructure.
- Undertake quality and safety assurance measures, protect the health and safety of our workforce and others, and conduct risk and security control and monitoring.
- Conduct research, analytics, and data analysis to assist in planning succession and to ensure business continuity, as well as to design employee retention programs and diversity initiatives.
- Perform identity verification, accounting, audit, and other internal functions, such as internal investigations.
- Operate and manage IT and communications systems and facilities, allocate company assets and human resources, and undertake strategic planning and project management.
- Comply with law, legal process, internal policies, and other requirements such as income tax deductions, record-keeping and reporting obligations, and exercise and defend legal claims.
We will retain your Personal Information for at least as long as needed or permitted for the purpose(s) described in this Jobs Privacy Policy and consistent with applicable law.
When We Disclose Information
We may disclose these categories of Personal Information, including currently and in the preceding 12 months, to the following parties:
- Business Partners and service providers. We share any Personal Information with third-party vendors and service providers that provide services to us for a variety of business purposes, such as credit reporting, managing benefits, payroll processing, provide internet service, email deployment, security and performance monitoring, maintaining or servicing accounts, data hosting, auditing, and data processing.

Your Rights and Choices
California residents have the following rights under the CCPA:
- Right to Know. You have the right to know what Personal Information we have collected about you.
- Right to Access and Data Portability. You have the right to request that we disclose certain information to you about collection and use of your Personal Information, including in a portable format.
- Right to Correct. You may have the right to request that we correct inaccurate Personal Information we maintain about you.
- Right to Delete. You may have the right to request that we delete your Personal Information that we collected from you and retained, subject to certain exceptions and legal obligations.
These rights are not absolute and are subject to limitations and exceptions provided in applicable law, such as when we are retaining personal information to comply with our legal obligations. For your protection, we take reasonable steps to verify your identity before implementing your request. You will not be discriminated against as a result of your choice to exercise these rights, although some account and personalization functionality may be lost when you exercise certain rights.
Security
We are committed to providing security for personal and business information. We use reasonable methods to protect information -, unfortunately, no security measure can be guaranteed 100% secure.
- Email and instant messaging are not recognized as secure communications, so we request that you not send sensitive information to us by email or instant messaging services.
- Individuals who are granted password access to restricted information on Boyd Gaming websites are prohibited from sharing those passwords with anyone. By accepting password access to a Boyd Gaming website, you agree to protect the password from discovery by anyone else. Boyd Gaming will not be responsible for any damages caused by the unauthorized use of your account. You are responsible for all activities that occur under your account. To protect against anyone acquiring your password, the following security measures are some, but not all, best practices:
- Create a strong password.
- Never give out your User ID or password.
- If you suspect that someone may have figured out your password, or even if you think it might have gotten lost, stolen, copied, or in any other way, compromised, please change it immediately and let us know.
